In Mexican real estate law, the Certificado de Libertad o Existencia de Gravamen is the single most critical preliminary certificate. Issued by INSEJUPY’s Public Registry division, this official document certifies whether a parcel is encumbered by mortgages, judicial attachments (embargos), tax liens, or usufruct rights.
1. Why Every Buyer Must Demand a Fresh Certificate
A property seller may present an older deed claiming clear title, but liens can be filed at any time up to the day of sale. In Yucatán, certificates are generally recognized as valid for 30 to 90 days. Before paying any earnest money deposit, verify that an up-to-date certificate has been issued.
2. Required Information for the Online Application
- Predio Identifier: Municipality, cadastral locality, street name/number, and plot number.
- Folio Electrónico: The unique registration number in the RPP database.
- Current Owner Name: Exact spelling matching the latest registered deed.
- Statutory Fee Tariff: Paid via official AAFY voucher or state payment gateway.
